ആത്മഹത്യാ കുറ്റകരമല്ല. കാരണം ശിക്ഷിക്കാൻ ആളുണ്ടാകില്ല.
എന്നാൽ ഇന്ത്യൻ പീനൽ കോഡ് സെക്ഷൻ 309 പ്രകാരം ആത്മഹത്യാ ശ്രമം കുറ്റകരം ആണ്. ഇതിനു ഒരു വർഷത്തിൽ കവിയാത്ത തടവോ പിഴയോ രണ്ടും കൂടിയോ ലഭിക്കാവുന്നതുമാണ്.
എന്നാൽ ആത്മഹത്യ ചെയ്യാൻ തീരുമാനിച്ച വ്യക്തിയുടെ അവസ്ഥ സഹാനുഭൂതിയോടും കരുതലോടും കാണണമെന്ന പരിഷ്കൃത മനുഷ്യന്റെ ചിന്ത ഇതിനെ ശിക്ഷയിൽ നിന്നും ഒഴിവാക്കണമെന്ന അഭിപ്രായത്തിൽ എത്തിച്ചു. ലോ കമ്മിഷൻ ഇത് പീനൽ കോഡിൽ നിന്നും ഒഴിവാക്കണമെന്നും നിർദ്ദേശിച്ചു. ഇതിനു വേണ്ടി ഒരു ബില്ല് പാർലമെന്റിൽ അവതരിപ്പിച്ചു എങ്കിലും അത് നിയമമായില്ല.
എന്നാൽ Mental Health Care Bill, 2013 പാസ്സായതോടു കൂടി ആത്മഹത്യാ ശ്രമം ഒരു മാനസീക രോഗാവസ്ഥ ആയി പരിഗണിച്ചു കുറ്റകരമല്ലാതെയാക്കി ശിക്ഷയിൽ നിന്നും ഒഴിവായി. അതായതു ഐപിസി സെക്ഷൻ 309 നിലനിൽക്കെ തന്നെ, മറ്റൊരു നിയമത്തിലൂടെ അത് കുറ്റകരമല്ലാതെയാക്കി.
(In article 124, that “Notwithstanding anything contained in section 309 of the Indian Penal Code, any person who attempts to commit suicide shall be presumed, unless proved otherwise, to be suffering from mental illness at the time of attempting suicide and shall not be liable to punishment under the said section.” It also provides that the Government shall have the duty to provide medical care to any such person attempting suicide. The Bill, therefore, does not repeal Section 309 of the Indian Penal Code, but merely provides the presumption of mental illness.)
